In the following we would like to present our general terms and conditions, which we use as a basis for processing and processing your purchase. We offer you the purchase of flamenco fashion items at www.flamenco-fashion.at.

1. CONCLUSION OF CONTRACT AND DELIVERY OF GOODS

  2. By clicking the button "buy now" you place a binding order for the items in the shopping cart. We will confirm receipt of your order immediately by email after sending the order. A binding contract is concluded upon receipt of this order confirmation. Please note that the delivery of the ordered goods takes place in advance (reservation) as soon as we have received the payment of the full purchase price and any shipping costs. Therefore, we ask you to transfer the purchase price immediately after receipt of the order confirmation, but at the latest within 7 days.
  3. Please note that, as an exception, we are not obliged to deliver the ordered goods and can therefore withdraw from the contract if we have properly ordered the goods from our supplier, but have not been supplied correctly or not in time (congruent cover transaction). It is also a prerequisite that we are not responsible for the lack of availability of goods and that we have informed you of this immediately. In addition, we must not have assumed the risk of procuring the goods ordered. Under these conditions, you also have the right to withdraw from the contract. If the goods are not available / withdrawal from the contract, we will immediately reimburse you for payments already made.
  4. We do not assume the risk of having to procure an ordered product (procurement risk). This also applies to the ordering of goods that are only described in terms of their type and characteristics (generic goods). We are only obliged to deliver from our stock of goods and the goods we have ordered from our suppliers. We deliver orders to you within Austria. If working days are specified as deadlines, we mean all days from Monday to Friday, with the exception of public holidays.

2. PRICES, SHIPPING COSTS AND EXPRESS SHIPPING

  1. The prices listed in the offer at the time of the order apply. The prices indicated are final prices (gross prices), which means that they include the applicable statutory value added tax. The goods remain our property until the purchase price has been paid in full.
  2. The shipping costs, except for express shipping, are currently 5.95 euros.
  3. Different shipping fees may apply to the shipping of particularly bulky, heavy or valuable items, which we specify individually for each product on the product detail page and on the order page during the sale.

 

3. PAYMENT

  1. Basically we offer the payment methods prepayment and Paypal. With every order we reserve the right not to offer certain payment methods and to refer to other payment methods. Please note that we only accept payments from accounts within the European Union (EU). You are responsible for any costs of a money transaction.
  2. The purchase price is due for payment on purchase on the day the customer receives the delivery. If the payment is not made within 14 days after the due date, the customer is in default. In the event of default, the statutory default interest will be charged.
  3. You agree that you will receive invoices, credit notes and reminders in electronic or paper form.
  4. In the case of an order with prepayment, the purchase price must be paid within seven days of the order. The item will only be sent to you after the full purchase price has been credited. If, despite the due date, your prepayment is not received in our account within a further seven days after receipt of a payment request, we can withdraw from the purchase contract.

 

5. GIFT VOUCHERS AND THEIR REDEEMING

  1. Gift vouchers are vouchers that you can purchase. These can only be redeemed for the purchase of flamenco fashion items, but not for the purchase of further gift vouchers. If the credit of a gift voucher is not sufficient for the order, the difference can be compensated with the payment options offered.
  2. Gift vouchers and credits can only be redeemed before the order process is completed. The credit of a gift voucher is neither paid out in cash, nor does it earn any interest. 6. LEGAL RIGHT OF WITHDRAWAL FOR flamenco fashion ITEMS

 

WHEN YOU BUY flamenco fashion ITEMS YOU HAVE A LEGAL RIGHT OF WITHDRAWAL:

We would like to inform you in advance that in the event of a goods return, you can use the return label, which is either enclosed with your order or which you can print out via your customer account. If you do not have a printer available, if you have difficulty downloading the return label or if you need a new return label, you can also request this via our customer service (contact details below). Please help us to avoid unnecessary costs and do not send the goods back without a return label.

CANCELLATION:

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods or, in the case of partial deliveries, the last delivery. To exercise your right of withdrawal, you must flamenco-fashion.at, Billrothstraße 12/1/26, 1190 Vienna, email: info@flamenco-fashion.at by means of a clear statement (e.g. a letter sent by post or email ) about your decision to cancel this contract. You can use the attached sample cancellation form. However, this is not mandatory. You can also electronically fill in and send the sample withdrawal form or another clear statement using the contact form on our website. If you make use of this option, we will send you a confirmation of receipt of your revocation immediately (e.g. by email). To meet the cancellation deadline, it is sufficient for you to send your communication regarding your exercise of the right of cancellation before the cancellation period expires.

Consequences of cancellation

If you withdraw from this contract, we have made all payments we have received from you, including delivery costs (with the exception of the additional costs that result from your choosing a different type of delivery than the cheapest standard delivery we offer have) to repay immediately and at the latest within fourteen days from the day on which we have received notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you. Under no circumstances will you be charged any fees for this repayment. We can refuse the repayment until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is the earlier. You must return or hand over the goods to us immediately and in any event no later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is met if you send off the goods before the period of fourteen days has expired. We bear the cost of returning the goods if you use the return label provided by us for a return within Austria. Otherwise you have to pay the return shipping costs. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the quality, properties and functionality of the goods.

 8. VOLUNTARY RETURN POLICY UP TO 30 DAYS AFTER RECEIVED GOODS

For all purchases made at www.flamenco-fashion.at, flamenco-fashion grants a voluntary right of return in excess of the statutory right of withdrawal for a total of 30 days. After that, you can also release yourself from the contract after the statutory right of withdrawal (see above) by returning the goods to us within 30 days of receipt of the goods (start of the period on the day after receipt of the goods). Timely dispatch is sufficient to meet the deadline. A prerequisite for exercising the right of return, however, is that you only carried the goods on for trying on, as in a shop, and that you send the goods back completely and intact in their original packaging. If you have problems downloading the return label or you do not have a printer available, please contact our customer service. The right of return does not exist for the purchase of gift vouchers and for contracts for the delivery of goods that, due to their nature, such as for hygienic reasons, are not suitable for return (e.g. opened cosmetic products).

There is no right of return for goods that, due to their nature, are not suitable for a return and goods that are made to measure (tailor-made) or tailored to the customer's personal needs, e.g. Customization.

9. Refunds

We automatically refund to the account you used for payment. If payment is made by invoice and prepayment, the remittance will be directed to the account from which the remittance was made. If you paid by PayPal or credit card, the refund will be made to the associated PayPal or credit card account. If you used a gift voucher when making your purchase, we will credit the corresponding amount to your gift voucher account.
